The balancing function of margin of appreciation is in two dimensions—namely, vertical and horizontal. In the vertical sense, the function of margin of appreciation is to balance between the powers of international courts/tribunals and the sovereignty of States. This is also referred to as deferential balancing. The margin of appreciation is a judicial doctrine whereby international courts allow states to have a measure of diversity in their interpretation of human rights treaty obligations.
